Private Prisons And Its Effects On The United States

This is a relatively new industry and it is startling to imagine how much power they will have in another 30-40 years. They have already managed to manipulate the fourth amendment. At this rate, your simple municipal violation might turn into an arrest record in the future. One possible sign of things to come happened with a Texas man, Jory Enck. He was thrown in jail for allegedly not returning a GED study guide to the public library. The non-profit public interest group, PR Watch, reported in 2012 about a foreboding incident in which CCA had participated in drug raids of an Arizona high school. The local police were provided with drug sniffing dogs by CCA. The school went into a prison style â€Å"lockdown† in which students were forced to line up against the wall and were not allowed to leave the building. This is part of a theme in which private prisons are specifically targeting adolescents to fill their juvenile facilities. There was a perfect example of this corruption with a scandal labeled as â€Å"cash for kids† by the media. Two Pennsylvania judges had accepted approximately $2.6 million in bribes from private juvenile detention centers. In return, those judges increased the number of youths in their facilities by convicting teens for minor offenses that normally would have been thrown out of court. One example was a 15 year old with no prior indiscretions, who spent three months in a boo t camp because she had created a MySpace page which mocked her high school sShow MoreRelatedPrivate Prison And Its Effects On The United States1284 Words   |  6 PagesLobbying As previously stated, private prison companies have to rely on the big prison population in order for them to make money because he main concern of these private corporations that run these facilities is money. Sexual assault on college campuses is a growing epidemic. Twenty five percent of college women are affected by sexual assault (A. Amar, T. Strout, S. Simpson, M. Cardiello, S. Beckford, 2014, p. 93). Sexual assault is the non- consensual sexual touching of a person, in which a person is forced to engage in a sexual act against their will. Taking advantage of a person sexually is morally wrong, and causes victims of sexual assault significant emotional and physical damage. Sexual assault is a big issue because it is destroying the lives of college students. No one, that is, attending college, and has their whole life in front of them should ever have to experience trauma from such an act and have their whole future compromised because of it. Sexual assault on college campuses can be managed by enforcing a strict no alcohol policy on college campuses, so that it can not be used as a weapon by rapists. Sexual assault can also be thwarted through sexual assault prevention workshops to educate students and staff about the issue, and through the college administration, reporting sexual assault to local authorities, so that the legal consequences of sexual assault can be implemented. This may persuade customers to not eat there, even if they are not going there for shark fin soup anyway. Their name could be soiled by the media, which in this case, is spread through the activist groups. Commercial and Contract Management

Question: Discuss about the Commercial and Contract Management. Answer: Introduction Commercial and Contract management is the concept through which all the parties to the contract totally understand their obligations and ensure that such obligations are fulfilled effectively and efficiently in order to get the best value for money. The role of mangers with respect to commercial and contract mangers are to keep a check on contract in order to ensure that the obligations of the contractors are met by them. A more modern approach to the concept of commercial and contract management would define it as a process of motivating, enabling and empowering contractors in order to derive additional value. According to Office of Government Commerce (2002), Contract management is the process that enables both parties to a contract to meet their obligations in order to deliver the objectives required from the contract. It also involves building a good working relationship between customer and provider. It continues throughout the life of a contract and involves managing proactivel y to anticipate future needs as well as reacting to situations that arise. I started with this definition to highlight the importance of contract management in any running project whereas in our company there is no contract management department taking care of all contracts of all our projects. I will be discussing in this paper about this issue within the company for most of our running projects, however I will select one of our main projects in Qatar market for geotechnical investigation, the Greenline Metro which is currently on going and expected to be completed by mid of 2017. I am working in ACTS a third-party leader company in geotechnical investigation and laboratory testing in the MENA region. My role here is decomposed to many tasks starting for being projects manager for most of our geotechnical investigation projects, monitoring all activities within the department, managing subcontractors, approving subcontractors invoices, issuing of financial work orders for the department on monthly basis covering all the works done in each month, working with the Head of division on reviewing some contracts. It took me couple of years to reach this career development and managing multi tasks in project management either in operations or in commercial. The main issues I would like to elaborate on are many commercial problems that was accompanied with this contract starting from the lack of internal communication and the negotiation pre-award, losing a lot of money due to outsourcing which in some cases it was not needed. I am choosing to discuss about these commercial issues because I believe that managing contracts of any project throughout the life cycle needs a good expertise to ensure performing all the obligations within the agreed contracts, between the client and us and between us and our subcontractors or suppliers. I want this to be clear in this paper because it will reflect the need of having a commercial manager in the company that fulfills his role as indicated by Lowe et al (1997) that he is a person controlling or administering the financial transactions of an organization with the primary aim of generating a profit including some activities that he can cover such as Manages the Commercial Team and plans, develops an d implements the Companys commercial plans for commercial and business development activities and must be adept at understanding and engaging in all aspects of the strategic function, which is where a specialist qualification in commercial management comes to the fore, in addition realizing project objectives, maximizing profit, taking advantage of opportunities and minimizing project risks and claims for loss and expense; negotiating and managing contract close-out, extensions or renewals as mentioned by Lowe (2013). From the above, the questions to be asked and treated in the next section are; Does the commercial manager is that important for solving the above highlighted issues? Can the company be improved and the project becoming more profitable by defining the pre award and post award activities for this manager? What are the key commercial concepts and principles that influenced these issues? This part of the essay, reviews the literature and relevant theories, which are available for the better management of commercial and contractual activities, so that the parties to the contract are able to get the best of the contract (Puil and Weele 2014). The main principles of Commercial and Contract Management (CCM) with respect to project management are related to success criteria, competitive advantage theories, value creation and relationship management of CCM. The principles of CCM are also with respect to body of knowledge and maturity of contracts (Puil and Weele 2014). The principles of CCM with respect to clients involve processes like assets and service identification, solution selection, requirement specification, services and assets procurement, service termination, asset disposal and management of contract. These principles also provided a guide for techniques like negotiating and drafting contracts, management of procurement strategies and contract management techniques such as value, risk, relationship and performance measuring management (Safa et al. 2016). The principles related to CCM also deal with the side of the suppliers. The principles include processes like opportunity development, implementation of projects, proposition identification, assets and services identification, disposal and termination. The principles also include techniques like bid management which includes estimation, strategies, models, pricing policies, resource procurement and production of the proposal along with contact management and drafting and negotiation of contracts (Sheikh, Jalil and Khan 2014). In order to adequately address the chosen issue in part A, it is very important to understand the importance of negotiation, communication and strategy with respect to commercial and contact management. Contact management refers to the process of efficiently and systematically managing the creation and execution of contract for the purpose o managing risks and maximizing financial and operational performance. Majority of contract management principles are related to post award strategies, but upstream and pre awards processes are also very important in contract management (Watson et al 2014). Organizations are increasingly facing problems with respect to improving performance as well as financial management and reducing cost. The identification of the need to drastically improve the contract management process is making it very significant to have professional contract managers within organizations (Mackin et al 2104). All contracts are founded so that they can get approval at different level and obtain the commitment of management. This includes the formulation of an appropriate business case with respect to the functional and operational strategies of the organizations. Contact and business objectives, policies and issues, which affect the investment and decisions, are set out in the business cases. The business case should be made in such a way that the contract fulfills its requirements and is affordable and achievable. The business case should address the outcome of the contact, important success factors, possible alternatives, the risks and their extent, time scale and identification of contingent needs. The business case has to be prepared by involving the end users where necessary and also the involvement of stakeholders. It has to be signed by the patrons and sponsors (Schooner and Castellano, 2016). Not only the time scale, complexity, nature and significance of procurement but also the extent to which it can be considered to be appropriate and beneficial, determine needs for having a separate team for contract and commercial management (Moduga et al. 2013). The factors which are to be considered before making a spate team for commercial and contract management are, the projects nature, nature of management style of the team and the work environment, internal and external communication. Along with the procurement, the tem can be derived from all sectors within the organization as relevant and appropriate. For example, teams like research and development, marketing and sales, finance and human resources, legal and design can be considered. The project may also opt to include the representative of the end users if it is an advantage for the organization. The individuals of these teams does not need to meet regularly, but based on the complexity of the project a core team can be cr eated and the members of which will meet regularly and this team will become the project management team. The importance of teamwork and the significance of the team leader have to be recognized (Puil and Weele 2014). The strategies with respect to a particular contract should be in compliance with the overall procurement strategies of the organization (Joy 2015). Contact management strategies, include relationship management, contract administration, subsequent service delivery, type of management to be adopted, per and post awards of contract and establishing the form of procurement. A successful contract management strategy can achieve benefits through, managing own responsibility of the organization during the contract, ensuring that the minimum performance criteria is met by the suppliers, developing effective relationships with suppliers to achieve short and long term supplier improvement. The issues, which need to be addressed while developing effective contract strategies, are significance, scale and nature of the organizations needs, value of needs, input or output specifications, market attractiveness and capacity, phasing and timescale and understanding the needs of suppliers and stakeh olders (Cruz and Marques 2013). There are various risks with respect to commercial and contractual activities. The Commercial and Contractual mangers have to follow a three way process with respect to these risks, risk analysis, assessment and mitigation. These three processes facilitate the taking of appropriate actions and decisions in order to control the risks appropriately. The process of risk analysis means the identification of potential issues, which can go wrong with respect to commercial and contractual business activities and then estimating the chances of each happening. Risk managements must be included in contract strategy formation as it is a fundamental part of such strategies (Kerzner 2013). Both formal and informal strategies can be adopted with respect to the process of risk management and the use of formal risk listing process should be adopted in case of complex projects (Burnett 2013). Outsourcing is the process by which an organization delegates its work to an outside source in order to make the process more cost effective. Outsourcing is not needs in an organization all the time and if this concept is applied all the time that it will cost the company more instead of bringing down the cost. Unnecessary outsourcing causes the organization to lose revenue and the use of such concept only must be done when it is necessary (Albano 2013). It is very important for the organizations to appraise suppliers. Supplier appraisal involves the evaluation of the potential capabilities of the suppliers to deliver goods and services to the organization in the present and in the future. Once this is approved, the supplier can be placed in the list of verified suppliers as a result the organizations do not have to conduct scanning for suppliers in the future. This process is very important with respect to successful supplier management, strategic sourcing and for the purpose of gaining competitive advantages with respect to procurement of goods and services (Kerzner 2013). It is the goal of every professional to arrange the best possible deal for his or her organization. This goal can only be achieved through the process of post tender negotiation. This strategy has to be integrated in the contract management strategy. If these negotiations ore conducted by the help of person who have expertise in that field, that it could be of a great help for the organization. Although it is to be noted, in this case that, no professional should adopt any unethical means for the purpose of such negotiations (Johnson 2014). The post management principles of contract are also vital for the organization. A company must appoint professionals for the purpose of relationships management with suppliers and service delivery management. The first is to maintain and develop a constructive relationship of the organization with the suppliers and the latter is to ensure that the services are performed in accordance to the terms of the contract. Changes in a contractual terms are investable, this becomes even more common when the the contract id of long term. Changes in the terms of a contract should not be a concern for the organizations and it should often be welcome if it increases the output of the contract (Wood 2014). In this part of the essay I was discuss how the principles and concepts discussed in part B of the assignment can be related to the issue. This segment will also also discuss how the codes and principles with respect to commercial and contractual management can be used effectively to address the issue and finding ways in which my role can be performed more efficiently and effectively along with how the activities can be performed in a more suitable manner The main issue, which I am taking about in this essay, is the problems faced in the process of pre contract negotiation and award management, unnecessary outsourcing and most importantly the lack of communication, which is the root cause of such problems. I need to develop a contract management plan for the purpose of my own role in the organization with respect to all the activities I have to perform regarding contract management. I need to allocate separate time for myself for the purpose of planning and preparing a business case, tender documents and drafting specification. Along with this, I also need to dedicate time and effort to determine how the contract is going to work once it has been awarded. The importance of contract management is very vital to the organization and it is more than essential to make a contract management plan before the contract is awarded. I should take time to consider how the obligations of parties can be carried smoothly and effectively. There are certain factors which I need to consider in order to fulfill by obligations with respect to the organization successfully. I should make proper arrangement with respect to service delivery so that both providers and consumers benefit from it. I need to ensur e that the organization is getting adequate value for money through the contracts and getting expected business benefits. I need to ensure that the parties to the contract are responsive and co-operative by setting guidelines and principles related to the same in the contract. I need to ensure that the customers are made aware of their obligations with respect to the contract. With respect to my role in the organization, I need to make sure that there are no disputes and surprises with respect to the contract. My role in the organization can be successfully carried on by making adequate flexibility in relation to the contractual parties especially in terms of partnership agreements. I should include such terms in the contract, which allows for changes in the terms of the contract if there is an occurrence of any unforeseeable problem. It is impossible to be certain about happening or non-happening of a certain event with respect to a contract (Turner 2016). Even if the risk management procedure as discussed in the part B of the essay is complied with thoroughly, there can still be scope for the rise of unforeseeable problems with respect to the contracts. I should be well equipped for problems, which may occur due to the change in the suppliers team after the contract has been awarded. I should set down guidelines on how the members with respect to the suppliers address Varity of issues in order to ensure that the problems are addressed adequately. I have to set methods and timescales thro ugh which the suppliers understanding and knowledge of the businesses of my organization can be enhanced and also transferred to the successive team members of the suppliers. It is very important for the purpose of my role in the organization to ensure that the guidelines set out in the contract demonstrate clear proof of success (or otherwise) with respect to the relationship. I need to ensure that the other parties to the contract can clearly identify their benefits with respect to the contract along with a distinct knowledge for the other party with respect to why they should contribute to the contract. I also need to understand the wants and expectations of the stakeholders and the end users with respect to the contract. Meeting the expectations of the stakeholders and the end users is an essential factor for the proper growth of the company (Samuel 2014). Usually the contract of our organization are short terms contract unless the projects is huge like the Greenline metro which is expected to last for three years from 2014-2017. With respect to this project, a lot of unforeseeable cost had to be incurred by us because we outsourced our workers to other companies and as a result, we ended up in a lot of scanning with respect to good suppliers, a lot of time was also consumed of the management in relation to reviewing contracts with other sub contractors. This also led to a higher transition cost for my organization. We also faced holdup problems with respect to the suppliers, as they were not able to live up to the contractual terms and agreements and some of them started to increase the per unit price intentionally. The main cause of such problems was that the organization did not have a proper contract management department, which is entrusted with the responsibility of addressing such issues effectively. This problem has to be solved by the organization by setting up an appropriate and separate team for the purpose of contract management as discussed in the part B of the essay. This team has to be set up taking representation from all the parts of the organization and also involving end users if it is beneficial for the organization. With respect to long term, contractual relationships as was in the Greeline project these teams can effectively mitigate the risks and problems, which are faced by my organization currently. My company also needs a contract exiting strategy with respect to long-term contracts like the Greenline project. A contract should only be brought to an end when both the parties to the contract have abided by their contractual obligations efficiently. This only occurs when all the aspects of the contract like price, time and delivery are met successfully. If the terms and conditions of a contract are not abided by, it account to the breach of the contract (CHENG, S ONG and YANG 2013). However, this was not the case with our organization with respect to the Greenline project and as a lesson; my organizations should develop a contract exiting strategy of its own with the help of experts. It is very important for my organization to identify the circumstances in which an early exit from a contract be desired and at time required. These measures have to be taken by the company when there is a major breach of terms on the part of the suppliers and on the event of frustrations of the contract. Breaches with respect to a legally binding agreement attract legal actions (Girth et al. 2012). My organization also needs to ensure that they have a specific team with respect to drafting of requirements and specifications. Specifications helps the suppliers to understand about the needs of the organization and what exactly the organizations expect from the, if such statement is drafted cautiously and is provided to the suppliers, it will be easy for them to fulfill the contractual obligations. In the initial stages if a professional team is appointed to draft the specification with reference to the business case, it would be great for my organization future growth. The management of the contract with Greenline with respect to outsourcing was not that good from the part of my organization. The main reason for this was the lack of a proper contract managing team whose knowledge and expertise is very essential for the management of such long-term projects. My organization should have revised its decisions about outsourcing with respect to its transaction cost. On the other had our company also missed out on one of the major principles of commercial and contract management, which is to analyze in details the requirement of the other parties to the contract. With respect to the long-term contract with Greenline, our organization has so far failed to analyze the needs of the company and as a result, my organization is facing difficulties in relation to the contract. The negotiation of a contract also forms an important part of contract management principles. Our organization was only represented by the department head for negotiation of the contract with Greenline. As he is not a specialist in that field, he was not able to negotiate the terms of the contract properly and a lot of relevant information, which would have benefited our organization, was missing in the contract. Concluding this section of the essay I would like to say that the organization would not have been in such, a position is it had an appropriate integrated commercial and contract management system. I have gained a lot of useful knowledge from this issue faced by my organization, so has my teammates and my organization themselves. I would like to discuss what we have learned through this issue and what was our next step towards reducing the risk of such events in the future. We have learned through this issue that the pre award activities are as important as post award activities with respect to a contract. It is very essential for our organization to find ways to reduce cost and enhance operational and financial performance. My organization has indentified that they need a professional contract management team with respect to both long and short term. I have gained the knowledge that it is very important for me to cautiously prepare the business case with respect to pre award management of contract so that the foundation of the contract is strong. I have also learnt that I need to develop pre contract strategies such strategies will involve managing my organizations own responsibilities as well as ensuring that the supplies are abiding by their contractual obligations. We as a team have understood the importance of risk assessment for the purpose of contract management. I have also learnt that unforeseeable circumstances may occur with respect to a contract and an early contract exit strategy has to be planned for circumstances where there is a signifiact breach in contractual terms. I have learned that I need allocate adequate time for planning the strategies with respect to the contract. My organization and I have adopted certain action plan with respect to contract management in the future so that we do not face such problem in the future. I have started paying extra attention towards my organizing skills so as to ensure that I leave do not leave out any relevant step with respect to contract management. I have learned the importance of pre-award contract management and have designed a plan so that I can concentrate more on such activities. My organizations have established an integrated contract management team for the purpose of contract management. The organization have entrusted the team with powers to control contracts on behaved of the organization. The organization has also appointer one professional contract negotiate for the purpose of contract negotiation. The organization has also set up a helpline number with respect to post-award delivery services of the contract. The organization has also appointed public relation offices whose duty will be to ensure that a contrastive and productive relationship is developed between the organization and the other parties to the contract. While doing this assignment I was enlightened with the fact that there are so many useful principles and concepts, which help us to manage contracts effectively and efficiently. I was little surprised to know the importance of pre contract strategies in the overall business scenario. The principles and concepts, which are available with respect to contract management, guide us on how to carry on our activities efficiently. The problems which my organizations and I were facing with respect to contractual management inspired me the most to find ways in which my I can help my organization with the issue. Due to vast availability of the resources with respect to the principles and guides of contract management, it was not that difficult for me to find principles, which were suitable for the issue faced by my organization and me. It was difficult for me to make the management understand the needs of these principles with respect to contracts entered into b y our organization. It was also difficult for the management and me to design an effective action plan in order to mange contracts. I discovered that I did not have much knowledge about contract management principles, which which could have resulted in negative outcome with respect to my future career development. I have acknowledged the importance of these principles in contact management and have taken a resolution to abide by them. I would like to change the approaches of the suppliers with respect to contract management, as it will not only benefit them but to the industry as a whole. In the future, I would defiantly not repeat t he mistakes, which I have made with respect to the contract with Greenline and always take an evidence-based approach towards my decisions. Hook the Mouse to Catch Events Outside an Application

Hook the Mouse to Catch Events Outside an Application Learn how to track the mouse activity even when your Delphi application is not active, sits in the tray or does not have any UI at all. By installing a system-wide (or global) mouse hook you can monitor what the user is doing with the mouse and act accordingly. What Is a Hook and How Does It Work? In short, a hook is a (callback) function you can create as part of a DLL (dynamic link library) or your application to monitor the goings on inside the Windows operating system. There are 2 types of hooks - global and local. A local hook monitors things happening only for a specific program (or thread). A global hook monitors the entire system (all threads). To create a global hook you need 2 projects, 1 to make the executable file and 1 to make a DLL containing the hook procedure. Our article on working with keyboard hooks from Delphi explains how to intercept the keyboard input for controls that cannot receive the input focus (like TImage). Hooking the Mouse By design, the movement of the mouse is restricted by the size of your desktop screen (including the Windows Task Bar). When you move the mouse to the left/right/top/bottom edge, the mouse will stop - as expected (if you do not have more that one monitor). Heres an idea for the system-wide mouse hook: If for example, you want to move the mouse to the right side of the screen when it moves toward the left edge (and touches it), you might write a global mouse hook to reposition the mouse pointer. You start by creating a dynamic link library project. The DLL should export two methods: HookMouse and UnHookMouse. The HookMouse procedure calls the SetWindowsHookEx API passing the WH_MOUSE for the first parameter - thus installing a hook procedure that monitors mouse messages. One of the parameters to the SetWindowsHookEx is your callback function Windows will call when there is a mouse message to be processed: SetWindowsHookEx(WH_MOUSE, HookProc, HInstance,0) ; The last parameter (value 0) in the SetWindowsHookEx defines we are registering a global hook. The HookProc parses the mouse related messages and sends a custom message (MouseHookMessage) to our test project: function HookProc(nCode: Integer; MsgID: WParam; Data: LParam): LResult; stdcall;var   Ã‚   mousePoint: TPoint;   Ã‚   notifyTestForm : boolean;   Ã‚   MouseDirection : TMouseDirection; begin   Ã‚   mousePoint : PMouseHookStruct(Data)^.pt;   Ã‚   notifyTestForm : false;   Ã‚   if (mousePoint.X 0) then   Ã‚   begin   Ã‚  Ã‚  Ã‚   Windows.SetCursorPos(-2 Screen.Width, mousePoint.y) ;   Ã‚  Ã‚  Ã‚   notifyTestForm : true;   Ã‚  Ã‚  Ã‚   MouseDirection : mdRight;   Ã‚   end;....  Ã‚   if notifyTestForm then   Ã‚   begin   Ã‚  Ã‚  Ã‚   PostMessage(FindWindow(TMainHookTestForm, nil), MouseHookMessage, MsgID, Integer(MouseDirection)) ;   Ã‚   end;  Ã‚   Result : CallNextHookEx(Hook,nCode,MsgID,Data) ;end; Tip: Read the Win32 SDK Help files to find out about the PMouseHookStruct record and the signature of the HookProc function. Note: A hook function does not need to send anything anywhere - the PostMessage call is used only to indicate that the DLL can communicate with the outer world. Mouse Hook "Listener" The MouseHookMessage message is posted to your test project - a form named TMainHookTestForm. Youll override the WndProc method to get the message and act as needed: procedure TMainHookTestForm.WndProc(var Message: TMessage) ;begin   Ã‚   inherited WndProc(Message) ;  Ã‚   if Message.Msg HookCommon.MouseHookMessage then   Ã‚   begin   Ã‚  Ã‚  Ã‚   //implementation found in the accompanying code   Ã‚  Ã‚  Ã‚   Signal(TMouseDirection(Message.LParam)) ;   Ã‚   end;end; Of course, when the form is created (OnCreate) you call the HookMouse procedure from the DLL, when it gets closed (OnDestroy) you call the UnHookMouse procedure. Note: Hooks tend to slow down the system because they increase the amount of processing the system must perform for each message. You should install a hook only when necessary, and remove it as soon as possible.

Louisiana Purchase Essay Example | Topics and Well Written Essays - 250 words

Louisiana Purchase - Essay Example The United States had initially set peace with the French and the Spanish people and had agreed not to bulge into their details but as soon as the rights of the American Merchants were curtailed, they decided to act accordingly. The settling of the Americans on the land led to the country starting the acquisition of the piece of land and this brought a lot of disturbance from the Spanish and the French who had just accommodated the United States as a gesture but were taking over piece by piece. This eventually led to a deal being signed (Fleming, 2007). President Jefferson was objective to the idea of acquiring the piece of land. The reason behind this was because he was known to be of a liberal mind. With this kind of attitude, he could not commit any activity that was not enlisted in the constitution. He however reconciled the issue by having his advisors convince him that the whole of the United States was starting to view him as a dictator. This made him engage in the deal to eliminate this notion from the minds of the Americans. The ramifications of this deal for the United Nations was that it was able to achieve respect from some of the countries that had assumed its power and that the land acquired could settle more

Horror Film Movie Review Example | Topics and Well Written Essays - 1750 words

Horror Film - Movie Review Example However, sometimes a filmmaker might choose to reveal these gratuitous aspects of their craft less directly, or even just imply them. As the genre of horror films grew more sophisticated in the mid portion of the 20th century, filmmakers such as Georges Franju began making important decisions about which horrific scenes to display and which so leave up to the audience's imagination. In his 1959 classic Eyes without a Face, Franju deliberately paces the film to heighten the anticipation of the truly graphic scenes. In this case, it is all about the audience's expectations. Meanwhile, the themes of the film were not simply bodily excess, but the full extensions of psychological control in its characters. Accordingly, the horror stems from the excessive control of a father over his daughter, his possible lover and the world around him. This level of control is reflected in the mask that the girl is forced to wear and the environment in which she is forced to live - only the latter of wh ich is the audience privy do early in the film. Ultimately, Eyes without a Face is an example of a horror film that makes use of invisible horror, in order to heighten the audience's awareness of what it may be about to see, and allow its imagination to run wild. Essentially, the film is driven forward by the moral choices of Dr. ... Genessier's daughter, Christiane, a most of all. Early in the film Louise briefly questions the actions of her employer - who, as the film implies, may also be her lover or even her husband, which could even make her Christiane's mother. Before the audience is even fully privy to the actions that the pair of murderers is taking, Louise states that she cannot go on, and Mr. Genessier promptly slaps her, which brings her back to her senses. This brief scene illustrates one of the main themes that will run throughout Eyes without a Face, which is the control of Mr. Genessier over everything in his life. The issue of control is significant because it highlights one of the ethical messages that Franju attempts to convey through the film. Since this is a horror film, it is not enough to merely illustrate how the control of one man over the lives of two women can be detrimental to everyone; instead, the audience must be brought face-to-face with the most extreme or even gruesome consequences of such a form of control. Genessier specifically wants to control the appearance of his daughter and, accordingly, the course of her life. The audience is left to infer that he believes that his daughter will have a better life if she is beautiful once again. However, this is never directly identified by Christiane as a personal goal belonging to her. This is clearly her father's goal. It is suggested that Mr. Genessier holds himself responsible for the injury to his daughter; but rather than attempting to correct the possible flaws in himself that led to her disfigurement, he acts to take more fir m command of her life, as well as the lives of other women in Paris. Women are abducted, mutilated and murdered with zero regard for their

Proposed Plan for Future Development for IKEA Coursework - 1

Proposed Plan for Future Development for IKEA - Coursework Example Environmental sensitiveness of the company is well recognized by consumers. The other companies that specialize in Nordic furniture design the in the US, whose prices are comparatively very high are Design Within Reach, Minimalista, Boconcept and Tema. But, the strategy of IKEA is to target middle-class families on a global level with a variety of designs, quality and price. Companies like Sears, JC-Penny, Flanigan and Raymour are competitors to IKEA in the USA. Competitors in Europe include companies like John Lewis, Argos, B&Q and TESCO. Apart from furniture, the extensive range of products of IKEA includes lighting, textiles & rugs, Kitchenware, flooring, storage furniture, beds and mattresses tools and hardware. The IKEA Concept is based on offering a wide range of well designed, functional home furnishing products at prices so low that as many people as possible will be able to afford them as mentioned in the website of Inter IKEA Systems B.V. The IKEA Concept guides the way IKEA products are designed, manufactured, transported, sold and assembled. 2 IKEA's business strategy hinges on sustainability and environmental design. The sustainability programs of IKEA envisage social, environmental and economic issues. Strengths and weaknesses of a company are mostly related to internal aspects. The internal environment of IKEA in terms of competitive advantage, market position and financial resources, is by and large conducive for a sustainable growth. The competitive advantage of a company arises out of several factors and the business plan which is very difficult to duplicate and the absence alternate products available cheaply enable IKEA to exploit the opportunities effectively and overcome the external threats. IKEA has established a name for itself with designs, quality and competitive pricing in the markets world over.

Analysis Of A Prayer For Owen Meany English Literature Essay

Analysis Of A Prayer For Owen Meany English Literature Essay The economical/political social background of the story A Prayer for Owen Meany by John Irving had a huge impact on the characters and the plot of the story. John Irving  chose to write about Americas political state throughout the story to connect it to past tragic events which have occurred in the main characters life. His writing style makes us aware of his view on Americas society and he too, like the main character in this book moved from America to Canada. Owen Meany claimed himself to be the instrument of God. His parents told him he was a virgin death; could he be the baby Christ? John Irving presented Owen with characteristics which made him seem like he is not part of this world. Owen could have been a tragic hero.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Many unpleasant events occurred throughout Owens life even though he was a virtuous person. He died by saving the life of Vietnamese kids. This connects to Romeo and Juliet, because when they died, their death made the Capulets and Montagues stop the feud and it made them notice how it was stupid of them to keep the two apart and they started to settle their differences. Before Owen died, his family would hate the Catholics for an event which occurred in their families past history. However, Owen died helping a nun take children to the washroom and so everyone realized their hate for each other was nonsensical. The major knew Owen had been a hero (616). A tragic hero always has a huge impact on the characters and readers, and Owen changed everyones opinion about who he truly was. I guess we were wrong about your little friend (556). Owen motivated the rev to find his lost faith and now he spoke with belief and confidence at the funeral. Ow en was not just a hero to the United States Army- he was our hero (556). There was something about him that attracted everyone. Even Johns mother loved Owen just like her own son. Owen would never complain about others and he would just stay there and take in the pain which symbolized him as a martyr. When he saw a man on the streets, he would want to help him right away. WE SHOULD STOP AND HELP THAT MAN (25). He had qualities which most of us humans dont possess no matter how noble and devoted we are. He even played the baby Christ in a play and that compared him to one of Gods messengers. He would follow the holy book and always asked: Does it say so in the bible? (170). Owens strange small size and very high voice was a symbol as well. This demonstrated to us how he was not a normal human but something different. Owen never tried to change his voice, because he knew it was for a purpose and it came from God. He was represented as a leader. He also  controlled people older than him and he even demanded the Catholics  to sign petitions against themselves. He was not intimidated by the bigger boys because he had been smaller (228). Everyone would listen to him such as the priests and he corrected them about their philosophy. Owen played the Lord Jesus in another play which showed his connection to God.   Owen was even known as the voice, because he represented everyones opinions and beliefs in the high school. Owen was exceptional, and all his differences portrayed him as Gods instrument. He didnt die unexpectedly without ever knowing. But since the day he was born, he knew his whole life ahead of him and he knew that  everything which happened to him was planned to happen, even his death. Therefore, he is related to a tragic hero because it was written in his destiny from the start. One important message the author tried to convey throughout the book was how strong the friendship between Owen and John was. Owen was the reason John got far in life and the author used many symbols and motifs to express it. After Johns mother died, Owen took her dressmakers dummy from John. DONT STARE AT THE DUMMY. ITS NOT GOOD FOR YOU (183). Owen knew the dummy would remind him of Tabitha. Not just did Owen take the dummy, but he took the baseball. The baseball symbolized the instrument of his mothers death. He also took Johns Armadillo which Dan had given to him, but he returned it after removing the claws. Without the claws, the armadillo could not be stable. All these items he took away from Owen were a motif throughout the book which represented how they both had lost something important, which they loved. In the beginning of the book, they mention Watahantowet who was an armless Indian Sagamore who owned land but lost it. This was also a reoccurring motif in the novel represe nting how they had less power and they were helpless. It even showed the pain caused by events which occurred in their life. At the end, Owen cut off Johns index finger to help John avoid joining the Vietnamese war. This shows us how John trusted Owen and placed confidence in him by knowing he had done the right thing. It seems as if Owen took a lot from John through his life. But, these examples showed us how he helped him and gave him more then what he took away. When Owen took the dressmakers dummy, John took Owens baseball cards which he loved. This conveyed how Owen wanted to communicate the feeling of loosing something important. Even at the end of the story, Owen died with his arm being blasted off. Once again, another motif of amputation of body parts represented pain and loss due to tragic incidents which occurred. When Tabitha passed away, to John and Owen, it was just like them losing an arm or breaking a leg. But to Owen, it also symbolized how he was gods instrument and his hands were being controlled by him. Owen tried to guide John. He repeated ninth grade for him and went to the same university as John and refused the offer to Harvard. John would always say: I learned it from you (502). This also creates a balance act, because on one side would be Johns most prized possessions and his only memory of his mother taken away from him. But on the other side would be the loss Owen went through for John such as living away from his parents and the meaning behind everything he took from John. Owen was a loyal and brave hero to John. He helped alleviate the losses in Johns life. In the story A Prayer for Owen Meany, the author John Irving conveys different messages. Many of the themes are connected to spirituality and portray life lessons you should follow. One important theme is based on fate, which is the belief  of the idea that your destiny is controlled by a certain force or power.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   One of the messages communicated is how everything happens for a reason, and the author shows us how strong the power of  fate is. In the novel, everything which occurred in Owens life was no coincidence. Owen believed that coincidence was a stupid, shallow refuge sought by stupid shallow people who were unable to accept the fact that their lives were shaped by a terrifying and awesome design (186). Within the previous quote, there is a metaphor which gives you an idea about how coincidences throughout your life arent arbitrary, but everything is written in your destiny and its as if your life is planned out. One example which supports that metaphor is the time during Johns mothers wedding. There was a huge storm and the author used pathetic fallacy to connect it to a horrible incident which was about to occur. It was very windy and  rainy; and Johns mother was hit by a hailstone on her head. This was a sign foreshadowing another upcom ing incident which would occur with her. When Owen was in bed feeling sick, he was walking to Tabithas room for comfort and it seemed as if he saw an angel. SOMEONE STRANGE IS IN HER ROOM. COME SEE! I THINK ITS AN ANGEL (79). This linked to another future event. It foreshadowed how Tabitha was going to die soon, because an angel of death represents taking away the soul. During Owens baseball games, he was never allowed to play. But once his coach let him get on the field, however he could never swing a pitch. As he was about to hit the ball, Johns mother was walking by. Ironically, Owen swung the bat with a good deal of force that the ball hit his mother and killed her. Owen believed that he saw the angel of death the night before, and stopped it from accomplishing its task for God. Since it was time for his mother to die, he had to finish  the task. Another tragic event which occurred in Owens life was the day he was playing football with John. He kicked the ball very far and the ir neighbours dog, Sagamore, ran after it. As Sagamore ran, he ran into a diaper truck and sadly died. The significance of this event  was a message from God demonstrating to Owen how he is the instrument of God, and he is controlled by Him. He is now given the power from God, and it motivates him in the future. Once, Owen was asked to play the ghost of the future in the play A Christmas Carol. No one knew why he was given that role and it only had a few lines which Owen disliked. But, as he was reading a name on a grave during his performance, he saw his own name and a date. IT WAS MY REAL NAME. IT SAID THE WHOLE THING. (254). The name revealed to him that he was going to be the ghost of the future and it gave away when his death would occur. Later, Owen had a dream. It was not just a nightmare, but it symbolized how God wanted him to accomplish an important task before he died. God  gave him instructions to his next task. I TRUST THAT GOD WILL HELP ME BECAUSE WHAT IM SUPPOSED TO DO LOOKS VERY HARD (400). The reason Owen was given that specific role to play was another way God wanted to show him how his death should occur. Throughout the novel, Johns mother would never tell him who his real father was. He never knew, until Owen died. Owen revealed to John who his real father was, in his afterlife. This shows us the reason why his mother never told him, because there was another way God wanted him to discover the truth. The way Owen was born had a special purpose to it too. His parents said that he was a virgin birth and therefore they disgraced Catholics.  As a result,  that created a feud. No one knew why he was born that way. Nevertheless, he was born unique and he served a purpose in life by helping so many people. Owen believed that there was a purpose to everything that happened-that god meant for the story of his life to have some meaning to it and god picked Owen(540). One motif in the book was Owen and John practising their basket-ball shot ov er and over again. They would try to break their record of scoring in 2 seconds. Later, they used this skill in an important part of the novel.   When the grenade was thrown at John, he caught it the same way Owen and him practised and they passed it to each other to stop it from exploding. Therefore, many disasters and tragic events occur in our lives and sometimes we dont deserve it. However, not only till the end do you receive the desired results you wanted from your hard work in life. Our life is like a pattern and we cannot control some circumstances,  however there is a reason for why they occur. The author had a way of communicating ideas which kept the book realistic but interesting. John Irving used various types of literary elements to convey his thoughts. The form he wrote in created a mood and tone which connected you to his characters. Owen had dreams which revealed his future tasks God wanted him to accomplish. He then went through many struggles to complete them for God. His dreams related to different stories of messengers of God written in holy books. One example is Abraham, and how he was told to sacrifice his son in his dream. This is related to Owens connection to God and how Owen isnt just a normal human. Another example in the book was how Owen had to cut off Johns index finger. This revealed how he gave the sacrifice by risking a chance of hurting his friend for God. Owen was also born a virgin birth and that is why he wasnt close with his parents due to the fact they told him this news when he was 10! But, he was born highly intelligent and even his physical looks were unique. Jesus was also born the same way with special abilities. This showed us an example of how the author brought in different ideas and fit them into the book to relate the characters to important figures and he used many allusions. Th e author also used many symbols, such as the armadillo, baseball and red dress which created examples of motifs throughout the book, which I have mentioned in the previous journals. John Irving wrote the story effectively and this caused the readers to become attached to the character of Owen Meany. The setting of the story which was during the early 1950s effects decisions the characters made. Johns mother decided to get a television when Owen was fifteen and this created an excitement. The television taught them more about the society rather than what they had seen. At that time, Christianity was also very important in the culture. However, as years went by, more immigrants started to settle in and the result was the loss of Americas identity. That is why this book is based around the theme of religion and many religious ceremonies occurred. Everyone believed in miracles and their life was dependent on faith. The author added a believable effect to the story by giving the characte rs realistic traits. Even though Owen Meany was Gods instrument and could be compared to a deferential and intelligent angel, he changed a lot. As he grew older, the people he grew up with changed him and he did start to smoke like most teenagers. As John and Owen matured, their feelings for Hester developed strongly. The thoughts through their minds would be of what males experience of the general public today. Owen was not completely pure, but he was a character which most of us would try to be like and he if we too did know him, he would have influenced us greatly. The author did not write chronologically, but put different pieces together of Johns life which revealed to us secrets throughout the end of the book. There was a thorough plot development in the book but sometimes the author dragged it on and you would want him to get to the point. It was a well written novel with many different morals and themes the author tried to get across: Religion, Friendship, Family, War, Faith and Death.

Buffalo Wild Wings :: essays research papers

In order for us to obtain our goal of increasing the profit by 3% in a 12 month period we needed to come up with who, what, how, and why we are going to get this goal accomplished. There are four different major categories of people that we are going to try and target. The first are the local sports families. The second are the typical sports fanatic. The third are the College Students. And the fourth are the traffic goers on route 24.   Ã‚  Ã‚  Ã‚  Ã‚  Our slogan at the time is â€Å"ALL THE ESSENTIALS†. But in order for us to reach different types of target market we need to add maybe another phrase after our slogan. For instance tagging on the phrase â€Å"Food, Fun, Beverages and your favorite sports† for the sports families and college students. But for the older group of sports fanatics and people who are looking for a cold one with the boys or with the gals, tagging on the phrase â€Å"Wings, Beer, and your favorite sports†. We will use these different phrases with the places that we are going to advertise to these specific targets, which we will get to next.   Ã‚  Ã‚  Ã‚  Ã‚  The first type of media we are going to use is event sponsorship to reach to sports fanatics and older men and women. Year around there are bowling leagues and softball leagues and soccer leagues that need to have team sponsors in order to pay for their equipment. This would be a perfect way to get our logo on a jersey and to promote coming to hang out after the game. I know that if I was sponsored by Buffalo Wild Wings that me and the boys would head to our sponsors place after the game. My personal favorite that we are going to do is our support media outdoor signage on route 24 targeting the flowing traffic coming from Fort Wayne, IN and Toledo, OH. There are going to be ten signs involved, five coming from either direction. One sign will be placed at the 69-24 loop and the other placed at the 75-24 loop just stating the Buffalo Wild Wings logo and promotion for Defiance, OH. Then when you are a mile out from each direction another promotion sign saying Buffalo Wild Wings next exit and another line saying â€Å"Count With Us!†. Then three more signs with the numbers 3, 2, and 1.

Henrik Ibsen- A Doll’s House

Henrik Ibsen was one of the most popular poet and dramatist in his time. He is considered as the father of modern realistic drama because he is responsible for the transition of the Romantic style going to modern realistic style of writing a play. The Norwegian playwright was born on Skien from Knud Ibsen and Marichen Altenburg, a relatively well-to-do merchant family. The family of Ibsen was one of oldest and distinguished family in their country. But the fortune of his family was taken away when he is going to its adulthood. Her mother turned to religion for support while his father financial situation was ruined because his father’s friend broke all connections with him and forced to bankruptcy in 1836 (Bellinger). Ibsen was motivated to go into playwriting by his mother. His mother was an enthusiastic painter and she loves theater. But because of situation of their family which was made them in to poverty, Ibsen at the age of 15 decided to go to Grimstad to be a pharmacist (Bellinger). In 1850, Ibsen goes to Christiania which is now called Oslo where he earned his journalistic writings in Heltberg. In this year also when his first written work was made and these were Catiline, a tragedy, which reflected the atmosphere of the revolutionary year of 1848, and The Burial Mound, written under the pseudonym of Brynjolf Bjarme. In 1858, returned to Christiania to apply his education in writing plays at Christiania’s National Theater and the same year when he married Suzannah Thoresen. All of the plays that were written by Ibsen were based on poverty and family problems. This was because on his past experience on his family. One of the plays that were written by Ibsen was the A Doll’s House. The said play, after being published received many criticisms about the traditional Victorian marriage. A Doll’s House-Critical Essay A Doll’s House was the first play that was written by Ibsen that has sensational effect on the audiences because it tackles on the norms of Victorian marriage. It is the most popular works that was written by Ibsen. The center of the story is about on Nora Helmer, who is the mother of the three children and the wife of Torvald Helemer who is a banker. The story is about on the marriage of the two characters that was ruined because the wife did not do her role as the mother and that she made an action that broke a law. The main points of Isben in his play were the family structure on his time and the way society thinks on the role of the father and the mother. The society in his time, after reading the play was patriarchal. It is very obvious because the play gives more importance on the male rather than equal opportunities. Ibsen designed the play in such a way that the audience can see the inequality of men and women as well the breakage of the norms in a marriage between husband and wife. The first secession of Nora in the society was when she committed a crime just to save the life of her wi fe.He was forced to forge the signature of his father so that he can borrow money that will be used for her husband’s treatment. The incidence showed that women can also make decision on their family and not the husband only. This is one of the norms in a Victorian marriage, were work, politics and decision are left from men while the household chores are women. The second secession of Nora in the society was when she decided to divorce her husband. In that time, divorce in never allowed by the society because it breaks the relationship of husband and wife. From the two secessions, it can be seen that the society dictates the relationship of a husband and wife and favors men. Nora secessions are very deliberate and thought out. She knows what society expects of her and continues to do what she feels is right despite them. Her secessions are used by Ibsen to show faults of society. Reference: Bellinger, Martha Fletcher. â€Å"A Short History of the Drama. † (1927). Novem ber 14, 2007 .

The Ones Who Walk Away From Omelas Essay Example

The Ones Who Walk Away From Omelas Essay Example The Ones Who Walk Away From Omelas Paper The Ones Who Walk Away From Omelas Paper The Ones Who Walk Away From Meals by Lee Cuing When you exist in this life, how many times you ask yourself: if this happens, what should I do? . I bet it is countless. There are so many authors use the what ifs sentences in their articles, and the short story The Ones Who Walk Away From Meals by Lee Cuing is the one. If its rain this morning, I dont go to school. This is an example of what ifs sentence which usually presents the reasons for something happened. In the story The Ones Who Walk Away From Meals, Lee Cuing uses a series of what Ifs to presents the reasons for what happened in Meals. For example, she states: If the child were brought up Into the sunlight out of that vile place, If It were done, In that day and hour all, the prosperity and beauty and delight of Meals would wither and be destroyed. , and also If the child could be released, It would not get much good of its freedom: a little vague pleasure of warmth and food, no doubt, but little more. One other reason that makes The Ones Who Walk Away From Meals becomes unusual is the way Lee Cuing creates a very short what ifs sentence. For example, she states: If you cant lick me, join me. If it hurts, repeat it. , or If so, please add an orgy. If an orgy would help, dont hesitate. . This makes a very powerful impressed to the readers. When I read the first paragraph, it seems like Lee Cuing draws a beautiful picture in my mind: Meals, bright-towered by the sea. The rigging of the boats In harbor sparkled with flags. In the streets between houses with red roofs and painted walls, between old moss-grown gardens and under avenues of Reese, past great parks and public bulging . I can Imagine Meals look Like a village which Is full of (Lee 2) peace in a fairy tales, where princes and princesses came from. Ive never seen a picture like that in any essay. A normal essay usually is the form which authors use to show personal points of their view. But when I finish reading The Ones Who Walk Away From Meals, I dont see any Lee Guns opinions about why people decide to leave Meals. She only tells how the child is confined, how people believe in the story about the confining child, ND how people feel after they see the child, but they cant help. I have to find the reasons that make people leaving Meals myself, and not sure if others have the same thought with me. This is a little success of Lee Gull to make the reader think about her story again and again after closing the book. By the way telling the tragedy about a confining child In Meals, Lee Gull uses her Imagination to create a story contains a metaphor for why do people avoid responsibility and walk away without doing anything to help the suffering. She breaks all ten rules to write an essay. Real evidences, real examples, Ana real Images are required in a success essay, which gives a clear answer for every topic the authors want to talk about. Open by the Joyous and cheerful scene of the Summer Festival, and end with the image of people silently leave Meals. Two opposite pictures in one short story. Lee Cuing doesnt tell why people walk away from Meals, where they go, and what next. By the open-ending, the readers can draw their own conclusion, this is a big different from a normal essay.

Why should anyone care about becoming an educated person Essay

Why should anyone care about becoming an educated person - Essay Example To give the readers a better understanding about this topic, this essay will first discuss about what an education person is and is not. In relation to the importance of continuous learning, reasons as to why each student should care about becoming an educated person will be tackled in details. most of us would aim to enroll ourselves in one of the colleges or local universities before we start a career in our chosen profession. However, the problem with some of us is that not all people who go through higher education are capable of utilizing what they have learned in school (Tauginas 9). Since not all people are capable of applying what they have learned into real-life situations, it is a wrong perception that becoming an educated person is all about receiving proper education. Hamilton mentioned that â€Å"becoming an educated person is ‘a lifelong process’†(82). It means that becoming an educated person should never be limited on receiving high grades in school curriculum nor by being able to complete the course requirements. Although receiving high grades in class is a stepping stone for further studies, it is essential for students to be aware that an educated person is way more than being able to receive high grades in one or more subject. Becoming an educated person is also more than being able to graduate from school. Furthermore, it is not about simply having a decent job nor being able to earn money (Hamilton 84). Instead, becoming an educated person is all about our ability to embrace new learning opportunities as it comes along our way. There are a lot of benefits associated with becoming an educated person. Aside from the fact that access to proper education can make us become a better person (Lin 21), becoming an educated person will definitely make us become well-rounded. Furthermore, access to

Social Media Policies, Concerted Activity and HR Management Research Paper

Social Media Policies, Concerted Activity and HR Management - Research Paper Example As the use of social media in workplaces continue to be entrenched in the normal work routines of employees, employers are finding a way to spy and eavesdrop on the discussions and opinions that employees have, concerning the organization. This has escalated to the extent where employees are using social media to punish or banish employees who make negative or disparaging remarks about the company. This paper discusses the ethical issues involved in the use of social media among employees and employers. In one case before NLRB, BMW fired one employee for posting on Facebook about the company serving hot dogs during a sales event instead of serving more upscale foods. The company management determined the comment to amount to disparaging remarks and fired the employee for ridiculing the company. The NLRB determined that the employee was unfairly dismissed because the issue of serving hot dogs to customers was of concern to other employees and that the company also stood to lose customers because of serving them with hot dogs. The board argued that the employee only engaged in protected concerted activity that the company stood to benefit if it changed the kind of foods it served its customers (Tanick, 2012). I agree with the decision by the NLRB in the case above because the company would be the final beneficiary as a result of serving upscale foods. In addition, the company failed to show that it had engaged the opinion of the employees on the kind of foods they were serving their customers. The above case would lead to better employee relations at BMW if the company management would have decided to assemble the views of the employees on the kind of foods they were serving their customers and give them an opportunity to suggest the foods they thought would attract more customers to the company dealership.
